Frequently Asked Questions

You will pay nothing out-of-pocket when you hire an Advocate.
Your initial consultation with us is always 100% free. There are never any upfront costs or hidden fees.
Our attorneys work on a contingency basis, which means that our attorney fees are calculated as a percentage of your settlement. We do not get paid unless we win your case, and you receive a settlement.
For more information on how settlements and payment work, please see our contingency fee information page.

If the accident resulted in injuries or significant property damage, it is a good idea to contact a lawyer. An experienced personal injury attorney can help you navigate the claims process, which can be lengthy and complex.
Your attorney will gather evidence, keep track of your medical records, negotiate with insurance companies, and represent you in court if necessary.

The best way to know if you have a case is to speak with an attorney. The Advocates offer free consultations—you can speak with a qualified legal team to understand what your case is worth without paying a dime.

Every personal injury case is different. There is no one-size-fits-all solution to accident claims. The length of the claims process will depend on the severity of your injuries, the willingness of the other party to settle, the court’s caseload, and more.
In general, personal injury cases can take anywhere from several months to several years. It is important to contact an attorney as soon as possible to get your case started. Each state has a statute of limitations for personal injury cases, after which you will lose your right of action.

When you hire The Advocates, we will begin investigating your accident immediately while you finish medical treatment. Once all evidence and medical records have been compiled, your attorney will send a demand letter to the other party’s insurance company. At this point, negotiations will begin.
In many cases, a settlement can be reached during negotiations. If the other party refuses to make a fair offer, you may choose to file a suit. In the litigation phase, your attorney will represent you in court in front of a judge, jury, and/or arbitrator.

When Should I Hire a Motorcycle Injury Attorney?

Our legal advice is first to seek out medical professionals after a crash. Motorcycle riders do not have the same protections as motorists, so it is vital to tend to your injuries immediately. Your health must come first. Soon after, you should begin the legal process of getting compensation. It is easy: Give The Advocates a call and one of our Utah motorcycle accident attorneys will do a case evaluation with you. You could live in Provo, Salt Lake City, Orem, or anywhere else in Utah; it does not matter. If you experience a motorcycle accident in this state, then you deserve compensation. You deserve an Advocate who can make that happen.

How to Be a Good Rider in Utah

The necessary equipment

Every motorcycle must be equipped with the following items:

  • One head lamp
  • One tail lamp
  • Either a tail lamp or separate lamp to illuminate the rear license plate with a white light
  • One red reflector on the rear
  • One stop lamp
  • A braking system
  • A horn or warning device
  • A muffler and emission control system which complies with Utah requirements
  • A mirror
  • Depth of tire tread no less than 2/32 inch
  • Footrests for any passenger
  • Handlebars not higher than shoulder height
  • All motorcycles manufactured after January 1, 1973, must be equipped with turn signals

Lane filtering in Utah

Lane filtering is when a motorcycle approaches two lanes of traffic heading the same way and rides between the lanes. According to Utah law, a rider can only do this if:

  • The posted speed limit must be 45 mph or less
  • The vehicles the motorcyclist passes must be fully stopped
  • When lane filtering, the motorcyclists cannot exceed 15 mph
  • The roadway must have two or more lanes headed in the same direction
  • Lane filtering is only allowed when the movement can be performed safely

As experienced Provo motorcycle accident lawyers, we highly recommend only performing this maneuver if you are an experienced rider. It is hard to take legal action on your behalf if you are the reason an accident occurs.

Check out Provo Canyon Scenic Drive

This route begins in Provo on US-189 and goes up Provo Canyon. Along the way, you can see Bridal Veils Falls, Heber Valley, and Deer Creek Reservoir. It is a wonderful place to take your motorcycle for a ride.
Exercise caution on the journey. The roads are single lanes and have lots of turns. While it is beautiful, motorcycle crashes are always possible on this drive.

Motorcycle Accident Claims and Personal Injury Law

Statute of limitations for motorcycle accidents

Motorcycle riders have four years to file a personal injury claim. Failure to file a motorcycle accident claim within this timeframe may bar you from using the legal process to get compensation.
There are some exceptions where you can file a motorcycle accident case after four years.

How fault for a personal injury claim is determined

Utah uses a modified comparative negligence rule to portion out fault for all types of accidents, from truck accidents to dog bites. Each party is assigned a certain percentage of fault.
You can recover compensation if you are less than 51% at fault.
If your fault is less than 50% then you can file an accident claim, but your final settlement will be reduced by your percentage of fault. Fault is based on evidence like:

  • Photos and videos of the accident scene
  • Witness testimony
  • Police reports
  • Physical evidence like vehicle damage and medical expenses for those involved in the accident

What damages can you seek fair compensation for?

A fair settlement compensates you for damages and losses you suffered. It might include:

  • Medical expenses
  • Lost wages
  • Loss of future earning capacity
  • Pain and suffering
  • Property damage
  • Funeral expenses for the wrongful death of a loved one

Common motorcycle accident injuries

Victims of motorcycle crashes often have much more severe injuries compared to motor vehicle accidents. Here are the most common types of injuries:

  • Lacerations and bruising (road rash)
  • Ligament tears or strains
  • Broken bones
  • Spinal cord injuries
  • Head injuries (usually in the form of a traumatic brain injury)
  • Wrongful death of a loved one
