If the accident resulted in injuries or significant property damage, it is a good idea to contact a lawyer. An experienced personal injury attorney can help you navigate the claims process, which can be lengthy and complex.
Your attorney will gather evidence, keep track of your medical records, negotiate with insurance companies, and represent you in court if necessary.

The best way to know if you have a case is to speak with an attorney. The Advocates offer free consultations—you can speak with a qualified legal team to understand what your case is worth without paying a dime.

Every personal injury case is different. There is no one-size-fits-all solution to accident claims. The length of the claims process will depend on the severity of your injuries, the willingness of the other party to settle, the court’s caseload, and more.
In general, personal injury cases can take anywhere from several months to several years. It is important to contact an attorney as soon as possible to get your case started. Each state has a statute of limitations for personal injury cases, after which you will lose your right of action.

When you hire The Advocates, we will begin investigating your accident immediately while you finish receiving medical attention. Once all evidence and medical records have been compiled, your attorney will send a demand letter to the other party’s insurance company. At this point, negotiations will begin.
In many cases, a settlement can be reached during negotiations. If the other party refuses to make a fair offer, you may choose to file a suit. In the litigation phase, your attorney will represent you in court in front of a judge, jury, and/or arbitrator.

Information About Biking in St. George

Best bike routes around St. George

The best way to avoid a bike crash with a motor vehicle is to go where they can’t. Bicyclists are much better off in areas designated for bikes and pedestrians.
Here are some routes around St. George worth checking out:

  • Red Hills Parkway: This is a mostly paved route that goes along the cliffs north of St. George. It is 8.3 miles long and a great way to see the spectacular red cliffs that southern Utah is famous for.
  • Utah Hill: This route is not for beginners. The ascent is challenging, but the views are glorious. Your reward for reaching the top is an easier downward journey aided by gravity. It’s 15 miles long.
  • Veyo Loop: This loop is 43.5 miles long. The good news is you don’t have to do that whole thing. Even just a ten-mile stretch is enough to get a good workout and see the lakes, canyons, and lava rocks surrounding St. George.

Biking within city limits

The city of St. George published a report stating, “Studies show that installing pedestrian and bicycle facilities directly improves safety by reducing the risk of pedestrian-automobile and bicycle-automobile crashes.”
This shows that local government recognizes the importance of biking infrastructure, but what has actually been done to make biking easier?
As of 2017, St. George has 151 miles of biker-friendly streets, routes, and paths. Here are the facilities you will find when biking in St. George:

  • Shared use paths: 55 miles of paved paths that cyclists, pedestrians, and non-motor vehicles can use.
  • Unpaved trails: There are 59 miles of mountain biking and hiking trails in St. George city limits.
  • Bike lanes: There are 14 miles of bike lanes within city limits, which is not too many, but the city plans to build more in the future.
  • Bike routes: These are roadways that highlight the legal right of cyclists to operate in the travel lane but do not necessarily have a dedicated space for bikes only. St. George has 24 miles of bike routes.

Common injuries from bicycle accidents

You are justified in filing a personal injury claim even if your injuries seem minor. These are some of the most severe injuries cyclists face:

  • Lacerations and bruising
  • Road rash
  • Ligament tears or strains
  • Broken bones
  • Scarring and disfigurement
  • Spinal cord injuries
  • Traumatic brain injuries and other head injuries
  • Wrongful death of a loved one

Personal Injury Law in Utah

What damages can you seek in a bicycle accident case?

Your case is unique to you. It is impossible to say what compensation you can seek until a bicycle accident attorney does a case evaluation of your accident.
Generally, these are the types of damages a personal injury lawyer will help you seek:

  • Medical bills
  • Lost wages
  • Loss of future earning capacity
  • Property damage
  • Non-economic damages like psychological trauma
  • Funeral and burial costs for fatalities

Is there a time limit for filing a biking accident claim?

Yes, there is.
In Utah, the statute of limitations for personal injuries is generally four years. The process of getting fair compensation is not fast, which is why our legal advice is to start your case quickly.
The statute of limitations for seeking compensation for property damage is three years.

Determining responsibility for the accident

Utah uses comparative negligence for personal injury and property damage lawsuits. Fault is assigned as a percentage.
This is a crucial part of the legal process. Nothing can proceed until negligence is established.
You cannot file a claim if you are more than 50% responsible for the accident. Imagine you bike through a stop sign at an intersection and get struck by a car that had the right of way. In this case, you will likely be the at-fault party assigned the majority of the fault for the case and, therefore, cannot sue.
You might be assigned 25% of the blame. If your fault is under 51%, you can still file a claim, but the percentage of your fault will reduce your final settlement—in this example, the compensation you receive from the accident will be 75% of the final settlement.
