Stages of a Personal Injury Case

MEET WITH YOUR ASSIGNED PERSONAL INJURY ATTORNEY AT OUR OFFICES IN SALT LAKE CITY, PROVO OR OGDEN. Your personal injury lawyer will also come to you if that is more convenient, while working through the issues of your personal claim. Your personal injury attorney will help you understand the personal injury case process, sign a contract, medical release and discuss your compensation for personal injury case.

COLLECT DATA. The Advocates, your personal injury lawyer, will collect medical records, bills, lost wage information, photos and other evidence to support your personal injury claim.

SEND OUT A DEMAND PACKET. Once you have recovered and/or are finished with your personal injury medical care and all records have been gathered, a demand packet is sent to the insurance company asking for a settlement of your personal claim. What is a compensation for injury demand packet? It is a packet of documents containing your personal injury medical bills, medical records, photos, lost wages documents, etc your personal injury lawyer gives to the insurance company to prove you were injured and states the amount of damages you have suffered because of the accident. You have a legal right for compensation for injury if your personal injury attorney sends a demand packet

NEGOTIATE A SETTLEMENT. At this point, we try to negotiate a settlement on your behalf.  If the at fault individual’s insurance refuses to settle the accident or injury case, we will file a complaint with the court. Most cases are resolved at this point. If there is no settlement a lawsuit is commenced.

WE SERVE THE DEFENDANT(S). The injured party in the accident or injury is the defendant, you.

DISCOVERY. This stage of the case varies in time frame. The defendant’s attorney and your serious injury attorney may exchange information and documents and depose witnesses in the discovery process.

EXPERTS. The defendant’s attorney and your lawyer for personal injury will obtain experts in different fields to support or oppose the personal injury suit claim.

SETTLEMENT DISCUSSIONS. When applicable, your lawyer for personal injury will discuss settlement amounts with you.  You may agree to take a settlement offer or continue to pursue the case. Your lawyer for personal injury will help direct you with your decision and give you advice, but the decision is up to you.

MEDIATION, ARBITRATION, OR TRIAL. If you chose not to settle, the case will either go to mediation, arbitration, or trial.  The defendant’s insurance company does not always make a settlement offer and, in that case, we will prepare the case for trial.

CASE IS CERTIFIED FOR TRIAL.

CASE IS TRIED BEFORE A JUDGE/JURY. In the State of Utah, if the defendant is found more than 50% at fault the jury will award damages.
